The process of discussing the draft Constitutional Law “On introducing amendments and addenda to the Constitution of the Republic of Uzbekistan” is actively ongoing.
Citizens, organizations and institutions, people’s representatives are actively participating in this important process.
Rasul Kusherbayev, one of the active deputies of the Legislative Chamber of the Oliy Majlis, made an important proposal on the activities of the Senate of the Oliy Majlis on his page on the social network. According to the deputy, members of the Senate of the Oliy Majlis cannot include representatives of the executive branch.
Thus, the deputy notes:
– The Senate of the Oliy Majlis is an integral and important part of the legislative power. Therefore, this link should be free from any influence and interference of the executive power.
Based on this, we believe that among the amendments to the Constitution it is necessary to establish that the members of the Senate of the Oliy Majlis could not include representatives of the executive branch, so that hokims, as representatives of the executive branch, would not be simultaneously representatives of the legislative branch.
This is typical for democratic societies and allows the principle of separation of powers and the system of checks and balances to fully function, – the deputy believes.
In fact, according to the principle of separation of powers, it is inappropriate for one representative to work simultaneously in both the legislative and executive branches of government.
